About us

We specialize in creating, connecting, and amplifying brands through digital marketing, media, and growth solutions. We combine strategy, creative, development, and media to build effective marketing ecosystems. This means that we help our clients address their marketing challenges, create their marketing approach, and connect our clients with our media partners to drive client growth.

With respect to Personal Information governed by this Policy, we may collect and use business Personal Information from our clients to provide them with our services. We may also obtain Personal Information from or about users of our Website or individuals that engage with our direct sales, marketing, or event services. As an integrated marketing agency, we use third-party platforms and advertising technology solutions to help deliver services such as analytics, media placement, attribution, CRM execution, and marketing automation. Therefore, while we facilitate client connections with our advertising publisher, networks, or platform partners, we do not collect Personal Information from or about individuals that may engage with our clients’ advertising campaign. Information we receive from such partners, if any, is shared in aggregate or de-identified form, and we do not attempt to reidentify the information. Accordingly, such information is not considered Personal Information and is, therefore, not governed by this Policy.

1. What information do we collect?

When you use our Services, we may collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“Personal Information”). Personal Information does not include information that is publicly available or de-identified, as defined by applicable law.

The Personal Information that we collect depends on the context of your interactions with us and the Services you use, the choices you make, and the products and features you use.

We may collect the following information from or about users of our Services:

Identifiers: Such as first and last name, business email address, business mailing address, billing address, business phone number, IP address.

Other Personal Information: Such as signature, title/position with your company, company name, and financial information for payment through our payment processing service provider.

Characteristics of protected classifications: Such as gender, race, sex, gender identity, sexual orientation, marital status, military/veteran status. Note that we may receive this information from our partners in aggregate form; we do not use this information to identify specific individuals.

Commercial Information: Such as products or services purchases, obtained, or considered, or other purchasing or consuming histories or tendencies.

Internet or other Electronic Network Activity Information: Such as browsing history, search history, information about your interaction with our website, advertisement, or other Services (such as date/time stamps, pages and files viewed, searches, and other features used), mobile device ID, information about your browser and operating system, language preferences, referring URLs, device name, country, and device event information (such as system activity, error reports (“crash dumps”), internet service provider, mobile carrier, and hardware settings).

Geolocation Data: Such as imprecise location data, for example, city, state; or precise location data, for example, a designated customer’s retail location. With respect to precise location data, Synergistic may receive this information in aggregate form from its partners.

Professional or Employment Information: As described above, such as business contact information, billing information, title/position, and company name.

Audio, Electronic, Visual, or Other Similar Information: Images and audio, video, or call recordings created in connection with our business activities.

Personas: Such as information about individual preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes provided to us by our partners. We receive this information in aggregate and do not use it to create individual profiles or identify a specific individual.

Sensitive Personal Information: Precise geolocation data, racial origin, religious or philosophical beliefs, and consumer health data collected by our partners and provided to us in aggregate form consistent with applicable law. We may also process ACH payment information through our third-party payment provider. As noted, we do not use this information to identify a specific individual or to make inferences about individuals.

Aggregated Data: As noted, we obtain from our partners aggregated data that does not directly identify a specific person. We may use aggregated information, for example, to understand insights about the effectiveness of our client’s media campaign, characteristics of audiences exposed to ads served under a client’s media campaign, the conversion of the number of impressions to the number of actual customers resulting from a client’s media campaign, or use of Personal Information to calculate the percentage of users accessing a specific Services feature.

2. How do we collect information?

We may collect Personal Information from or about you in the following ways:

Directly from you.For example, when you complete forms (such as our “Ready to Grow” contact form); enter into an agreement with us; sign in to your account or otherwise access or use our Services; provide feedback, complete surveys, or request customer service; post comments, photos, videos, or other information to our social media pages or when you review us; or when you otherwise communicate with us via the Services.

All Personal Information that you provide to us must be true, complete, and accurate and you must let us know of any changes to your Personal Information. You may always choose not to share your Personal Information directly with us. Please note, however, that if you choose not to share required Personal Information, then you may not be able to use some of our Services. Note that information posted on publicly available sites, like social media sites, is not subject to this Policy.

Automatically from your Equipment. When you access or use our Services, and with your consent if required, information associated with you and/or your Equipment may automatically be collected or received through device-based tracking technologies such as cookies, pixels, tags, beacons, or other technology. Such technologies may be deployed by us or by third-party partners that provide analytics, marketing, or advertising support. We use this data to operate and improve our Services, understand usage, and support marketing performance.

We also use tracking technologies when delivering advertising or analytics services for our clients. In those cases, information may be collected from end users who view or interact with content we place or manage.

Further, we may automatically collect or receive such information any time you interact with our advertising and content on other websites and platforms.

Finally, third parties, including advertisers, media platforms, analytics providers, and publishers, may also collect information through similar technologies when users engage with ads or content we deliver.

From third parties. We may receive information about you from third-party vendors, ad technology platforms, marketing technology providers, and service providers that support our operations or enable the media and marketing services we provide. These may include companies or platforms that host or operate our Services, process payments for us, send emails for us, provide marketing automation, analytics and measurement, and advertising services, or host our content. We may combine that information with information we collect directly from you. We also may receive Personal Information from business partners that we engage to share consumer information with us. We may also obtain Personal Information about you from advertising publishers, networks, or platforms and search information and social media providers. Additionally, other users of our Services may provide us with your Personal Information so that we may invite you to use our Services.

For example, we may enter into agreements with third-party publishers to provide our clients with our services under a consulting agreement. Those third-party publishers may collect or use Personal Information from or about users on services on which they place advertisements, including for cross-contextual behavior advertising purposes. While we do not collect or retain from our third-party publishers any raw Personal Information they may collect, we do analyze and assess the associated aggregated reporting and analysis provided to us by our third-party advertisers (e.g., aggregated information). While we seek only to review and assess aggregated information and do not use aggregated information shared with us to identify a specific individual, to the extent any Personal Information is shared with us under such third-party agreement, it will be handled in accordance with this Privacy Notice.

3. How do we use and share your information?

In Short: We process your information, in part, to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent, consistent with applicable law.

We may use or disclose Personal Information for the following purposes:

• To provide you with Services that you have requested, including processing payments, and providing you with updates about the status of your service(s).
• To manage our relationship with you, which may include notifying you about changes to our Services, Terms of Service, or Privacy Policy, providing you with notices about your account, asking you to provide feedback or take a survey, or addressing any questions you may have about our services.
• To deliver relevant content, advertisements, and messaging to you and to measure or understand the effectiveness of such content, advertisements, and messaging.
• To respond to your requests to us, including to exercise any data subject rights you may have, or to fulfill any other purpose for which you provide the information.
• To improve our Services, including by analyzing your information and performance data and creating aggregated data derived from your information to develop, maintain, analyze, improve, optimize, measure, and report on our Services and their features and how users interact with them. We may use artificial intelligence to help us analyze aggregated performance data.
• To improve our marketing, customer relationships, and experiences.
• To contact you about our own or third parties’ products and services that may be of interest to you.
• To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
• With your consent, consistent with applicable law.
• For any other purpose as may be permitted by law or that we describe when you provide the information.

We may also use or disclose Personal Information in the following circumstances:

• To comply with any court order, law, or legal process, including responding to any legal government or regulatory request.
• To enforce our Terms of Service, this Policy, or other applicable policies or agreements with you.
• To protect the rights, property, or safety of our business, employees, customers, or others. This includes exchanging information with other companies and organizations for the purposes of cybersecurity, fraud protection, and credit risk reduction.
• To investigate suspected violations of any law, rule or regulation, or the terms or policies for our website.
• To support or as part of a business transfer in connection with, or during negotiations of, any merger, sale of our assets, financing, or acquisition of all or a portion of our business to another company.

Our legal bases for processing Personal Information, under applicable EU/UK law

• With your consent for one or more specific purposes;
• When processing is necessary for the performance of a contract to which you are a party or to take steps at your request prior to entering into a contract;
• When processing is necessary for compliance with a legal obligation to which we are subject;
• When processing is necessary to protect your vital interests or of another natural person; or
• When processing is necessary for the purposes of our legitimate interests or those of a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of Personal Information. For example, our legitimate interests may include fraud prevention, ensuring network information security, and/or identifying possible criminal activity or threats to public safety.

To whom we disclose Personal Information

We may disclose Personal Information as follows:

Service providers and contractors. We may share Personal Information with vendors who help us with certain services, including customer support, email and text message deployment, research and analytics, marketing and advertising services, data processing, management, analytics, background checks, fraud prevention, transaction and payment processing, and survey administration.

Business Partners, Advertisers, and other Third Parties. With appropriate consent where required, we may share Personal Information with or make it available to our sponsors, partners, advertising networks, advertising servers, and analytics companies or other third parties in connection with our and their marketing, promotional and other commercial purposes and offers, as well as product information. Further, such third parties may use Personal Information and other data collected to provide services to us and our customers in artificial intelligence tools and to train their underlying models.

We also use Google Analytics to analyze use of our Services. For more information about how Google uses information from sites or apps that use its services, please visit https://policies.google.com/technologies/partner-sites.

The typefaces on our website are served by Adobe Fonts. When you load a page, your browser requests font files from Adobe’s servers, which discloses your IP address and basic browser information to Adobe. This request is necessary to display the site as designed and does not involve advertising cookies. We may also disclose Personal Information in the following circumstances:

Law Enforcement, Regulators, Courts, and other Governmental Authorities. We may share any of the categories of Personal Information we collect, pursuant to applicable law, to respond to subpoenas, court orders, legal process, and other law enforcement measures, to comply with other legal obligations, to respond to an emergency, or otherwise to protect our or the rights, property, safety, or security of other parties, visitors to or users of our Services, or the public.

Business or Asset Transfers. If we are involved in a merger, acquisition, transfer of control, bankruptcy, reorganization, or sale of assets, or diligence associated with such matters, we may share Personal Information with relevant stakeholders. For example, if another entity acquires us or all or substantially all our assets or assets relating to any of our businesses, your information may be disclosed to that entity as part of the due diligence process and may be transferred to that entity as one of the transferred assets.

Note that we do not sell or share (as those terms are defined by applicable law) Sensitive Personal Information that we collect from consumers, nor do we use Sensitive Personal Information to make inferences about individuals.

4. Do we use cookies and other tracking technologies?

In Short: We may use cookies and other tracking technologies to collect and store your information.

With your consent if required, we may automatically receive and store certain types of Personal Information whenever you access, interact with, or use our Services. For example, we may use “cookies” and “web beacons” (also called “clear gifs” or “pixel tags”) to obtain certain information when you use or access our Services. We may use information collected via these technologies to:

• Estimate our audience size and usage patterns.
• Store your preferences, so that we may customize our Services according to your individual interests.
• Speed up your searches.
• Recognize you when you return to our Services.

Cookies are small files that we may transfer to your Equipment’s hard drive or to your web browser’s memory to enable our systems to recognize your browser and to provide convenience and other features to you. We may also use cookies to provide additional features or functionality to your experience when you use our Services, for example, storing your preferences and other information about you when you use the Website. You may block or limit the storage of cookies via browser controls or other software. You may also delete cookies manually from your device through your internet browser, operating system, or other programs you use to access the Services. Please note that some portions of our Services may not function properly or be available if you block or delete certain cookies.

Web beacons (also known as web bugs, clear GIFs, or pixel tags) are tiny graphics with a unique identifier, similar in function to cookies, and may be used to track the online movements of users, when an email has been opened, or to provide other information.

Note: As an integrated marketing agency, we use third-party platforms and advertising technology solutions to help deliver client services such as analytics, media placement, attribution, CRM execution, and marketing automation. In most cases, data collected or processed through these platforms is used for campaign execution, performance measurement, or audience targeting within those platforms. We do not resell or exchange Personal Information for monetary value. If Personal Information is provided to or processed by third-party platforms, it is typically processed on our behalf or on behalf of our clients to perform contracted marketing services rather than for sale or unrelated use.

We do, however, use advertising, analytics, or audience measurement tools or other platforms that support targeted advertising or cross-contextual audience delivery for client campaigns.

Opt-Out/Revoke Consent: To the extent any of these automated technologies are considered a Personal Information sale, targeted advertising, or profiling, under applicable laws, depending on in which U.S. state you are a resident, you may opt out from use of these automated technologies for such uses as described in Your Rights and Choices below. You may also revoke your consent to use such technologies at any time. Please note that some Service features may be unavailable as a result.

Additionally, when you interact with the Services, there are third parties that may use automatic collection technologies to collect information about you or your Equipment. These third parties may include advertisers, ad networks, and ad servers, analytics companies, your Equipment manufacturer, your internet or mobile service providers, etc. These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites, apps, platforms, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the provider responsible directly.

You can refuse certain cookies through the cookie banner presented on your first visit, or change your choice at any time using the Cookie settings link in the site footer.

5. How long do we keep your information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise permitted or required by law.

We will only keep your Personal Information for as long as it is necessary for the purposes for which we collect it, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize such information, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

6. How do we keep your information safe?

In Short: We aim to protect your Personal Information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any Personal Information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your Personal Information, transmission of Personal Information to and from our Services is at your own risk. You should only access the Services within a secure environment.

7. Do we collect information from minors?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

Our Services are not intended for individuals under 18 years of age. We do not knowingly collect, sell, or share (as those terms are defined by applicable law) the Personal Information of any individual under 18. If you are under 18, do not use our Services or provide any information to us. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services.

8. What are your privacy rights and choices?

In Short: We have developed the following mechanisms to give you more control over your Personal Information. Further, depending on in which U.S. state or country you reside, you may have additional rights regarding your Personal Information.

You may review, change, or terminate your account with us at any time.

Withdrawing your consent:If we are relying on your consent to process your Personal Information, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by using the contact details provided in the section “How can you contact us about this notice?” below. However, please note that this will not affect the lawfulness of the processing before consent is withdrawn nor, when applicable law allows, will it affect the processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications:You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying ‘STOP’ or ‘UNSUBSCRIBE’ to the SMS messages that we send, or by contacting us using the details provided in the section “How can you contact us about this notice?” below. You will then be removed from the marketing lists. However, we may still communicate with you, for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Cookies and Automatic Data Collection Technologies: You may be able to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. Interest-Based Advertising: Please see Do We Use Cookies and Other Tracking Technologies? above and Data Subject Access Rights below for information on how to opt out of interest-based advertising.

Location Data:We collect location data such as information about your Equipment’s location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.

Data subject access rights

Depending on in which U.S. state or country you are resident, you may have the following rights related to your Personal Information. These rights include:

• The right to know what Personal Information we process about you.
• The right to request certain Personal Information that we process about you be deleted and/or the right to erasure (“right to be forgotten”).
• The right to request we correct Personal Information we have about you which you believe is incorrect.
• The right to have certain Personal Information we process about you returned to you in an accessible and useable format upon your request, if such request is technically feasible.
• The right to opt out of having your Personal Information processed in such a way that enables us to create a profile of inferences about you or for targeted advertising purposes.
• The right to limit the use of your Sensitive Personal Information.
• The right to opt out of the sale of your Personal Information.
• The right to opt out of any profiling in furtherance of decisions that produce legal or similarly significant effects.
• The right to withdraw your consent.
• The right to exercise your data subject rights free from discriminatory treatment, including if you are an employee, applicant, or independent contractor, the right against employment-related retaliation for exercising your privacy rights.

If you are located in the EEA or UK and you believe we are unlawfully processing your Personal Information, you also have the right to:

• Object to or restrict our processing of your Personal Information; and/or

Nevada Residents.Nevada provides its residents with a limited right to opt out of certain Personal Information sales. Residents who wish to exercise their sale opt-out rights may submit a request as provided in the Contact Us section below. However, please know we do not sell data triggering that statute’s opt-out requirements.

Exercising your data subject rights

To exercise any applicable data subject rights, please submit a request to privacy@synergistic.io, or use the contact details at the bottom of this document.

How we verify data subject rights requests

We may require that your identity be verified prior to processing verifiable rights requests. If your request requires verification, we will verify your identity by comparing the information we have about you against the information we receive when you submit your request. If we do not have enough information to verify your identity, we may request additional information from you, consistent with applicable law. We may deny a rights request if we are unable to verify your identity.

Authorized agents

Some U.S. states and the EU, UK, and Switzerland permit their residents to designate an authorized agent to submit requests to exercise certain data subject rights on the individual’s behalf. Even if you use an authorized agent to submit a request on your behalf, pursuant to applicable law, we may still require that you verify your identity depending on the nature of the request and sensitivity of the information at issue.

If you are an authorized agent submitting a request on behalf of an individual, please submit a request using the contact information provided in the Contact Us section below. You must include a copy of the written, signed permission indicating that you are permitted to act on that person’s behalf.

Appealing a denied data subject rights request

In some circumstances, we may deny your request to exercise one or more of the rights described above. Some U.S. states, the EU, UK, and Switzerland permit their residents to appeal a denied data subject rights request. Depending on in which U.S. state you reside, if you disagree with our decision to deny your request or any portion of your request, you may appeal our decision within sixty (60) days of receipt of notice that your request has been denied. If you submit an appeal to a denied request more than sixty (60) days after you have been notified of our decision to deny the request, we may deny your appeal. If you submit a timely appeal, we will respond within forty-five (45) days of our receipt of your appeal.

If you wish to appeal a decision, please clearly and plainly describe your basis of disagreement with our decision by responding through the same means by which we communicated our decision or by submitting your appeal using the information provided in the Contact Us section below. We will review your appeal and either amend or uphold our decision. In either case, we will provide a written explanation of the reason for the decision. This decision will be final.

9. Universal opt-out mechanisms

As required by law, we will recognize universal opt-out mechanisms or opt-out signals sent through your browser to opt out of the selling or sharing, as defined by applicable law, of your Personal Information.

10. Do California residents have specific privacy rights?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your Personal Information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about certain categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident, please note that it is our policy not to share Personal Information of California residents with third parties for their direct marketing purposes if those individuals have exercised their right to opt out. You may opt out of such sharing with third parties for direct marketing purposes cost-free as described in this Policy, by contacting us at privacy@synergistic.io, or by referring to the contact details at the bottom of this document.

As noted, our Services are intended for individuals 18 or over. If you are under 18, please do not use our services, including creating an account with or sharing any information with us. If you are under 18 years of age, reside in California, and have a registered account with Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

CCPA privacy notice

The California Code of Regulations defines a “resident” as:

• Every individual who is in the State of California for other than a temporary or transitory purpose
• Every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose

All other individuals are defined as “non-residents.” If this definition of “resident” applies to you, we must adhere to certain rights and obligations regarding your Personal Information.

What categories of Personal Information do we collect?

We may also collect other Personal Information outside of these categories through instances where you interact with us in person, online, or by phone or mail in the context of:

• Receiving help through our customer support channels
• Participation in customer surveys or contests
• Facilitation in the delivery of our Services and to respond to your inquiries.

If you are using an authorized agent to exercise your right to opt out, we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

Will your information be shared with anyone else?

We may disclose your Personal Information as described above. We disclose Personal Information with our vendors pursuant to a written contract between us and each vendor. Each vendor is a for-profit entity that processes the information on our behalf.

We may use your Personal Information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be “selling” of your Personal Information.

Synergistic Designs LLC has shared or sold Personal Information in the categories noted above to third parties for a business or commercial purpose in the preceding twelve (12) months.

11. Cross-border transfers of personal information

We may transfer your Personal Information to countries outside of your country of residence, including to jurisdictions that may not provide the same level of data protection as your home country.
